Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Verimo platform and services ("Services") provided by ITIFY BV ("Company", "we", "us"). By creating an account or using our Services, you agree to be bound by these Terms.

1. Definitions

  • "Platform" means the Verimo ATS web application and associated APIs.
  • "Tenant" means a customer organization and its associated data environment.
  • "User" means any individual authorized by a Tenant to access the Platform.
  • "Candidate" means a job applicant whose data is processed through the Platform.

2. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use.

3. Acceptable Use

You agree not to use the Platform to:

  • Process personal data in violation of applicable data protection laws
  • Discriminate against candidates on the basis of protected characteristics
  • Upload malicious software or attempt to breach Platform security
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Resell, sublicense, or commercially exploit the Platform without authorization
  • Interfere with or disrupt the integrity or performance of the Platform

4. Data Processing

As a Tenant, you are the data controller for Candidate personal data. We act as a data processor. Our Data Processing Agreement (DPA), incorporated by reference, sets out the terms under which we process personal data on your behalf. You warrant that you have obtained all necessary consents and have a legal basis for processing Candidate data.

5. Fees and Payment

Fees are based on the subscription plan selected at registration. All fees are exclusive of VAT. Payments are processed via Mollie. Failure to pay may result in suspension of your Tenant account. We reserve the right to change pricing with 30 days' notice.

6. Intellectual Property

The Platform and all related software, designs, and content are owned by ITIFY BV and licensed to you on a limited, non-exclusive, non-transferable basis. You retain ownership of your data. We may use anonymized and aggregated data for platform improvement and analytics.

7. Confidentiality and Security

We implement industry-standard security measures to protect your data. Both parties agree to maintain the confidentiality of any proprietary or confidential information disclosed during the use of the Platform. We will notify you without undue delay of any data breach affecting your Tenant data.

8. Termination

You may terminate your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or upon 30 days' notice for convenience. Upon termination, your data will be retained according to our retention policy and then securely deleted.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability shall not exceed the total amount paid by you to us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, or consequential damages.

10. Governing Law

These Terms are governed by the laws of Belgium. Any disputes shall be resolved in the courts of Brussels, Belgium. If any provision is found unenforceable, the remaining provisions shall continue in full effect.
